Senior Living Terms of Service

This is the agreement for Elite Pianist Senior Living, the institutional membership for a senior living community. The community is the customer, one membership covers one licensed facility, and the membership is arranged directly with us.

Your Agreement With Us

These Senior Living Terms of Service are the agreement between the senior living community or facility (“you,” the “community” or the “facility”) and The Elite Pianist, LLC for Elite Pianist Senior Living — the institutional membership that provides Elite Pianist live programming and performance library access for authorized resident programming at a licensed facility (together with the website and member area, the “Service”).

By purchasing or using an Elite Pianist Senior Living membership, the community accepts these Terms, the Institutional Viewing License and our Privacy Policy, and the person accepting confirms that they are authorized to enter into this agreement for the community.

Which agreement applies

This document governs the institutional Senior Living membership. The individual memberships sold on our consumer website are a different product, for individual use by a named subscriber, and they are governed by the separate Elite Pianist Terms of Service. An individual membership is not a substitute for this institutional membership and carries no group viewing rights.

If the community does not agree with these Terms, please do not purchase or use the Service.

Who We Are

The Service is provided by The Elite Pianist, LLC, a limited liability company organized under the laws of the Commonwealth of Pennsylvania, United States.

What Elite Pianist Senior Living Is

Elite Pianist Senior Living is an institutional membership for a senior living community. It provides the community with authorized access to Elite Pianist programming for resident and community programming at its licensed facility.

An active membership currently provides access to the Senior Living member experience, including:

  • upcoming live performances;
  • the available performance library;
  • supported viewing perspectives on library performances;
  • account access for the community; and
  • other Senior Living content and features we make available through the Service.

Elite Pianist Senior Living is not one of the individual memberships, is not priced or billed per resident, and is not purchased through the consumer checkout. It is arranged directly with us, as described under Billing and Payment.

The Community Is the Customer

With an institutional membership, the customer is the community or facility — not any individual resident, family member, guest or staff member. The community holds the membership, billing is to the community, and the rights described here belong to the community and are exercised by the people it authorizes.

Residents take part in programming the community presents under its membership. Nothing in these Terms creates a separate paid subscription or contractual relationship between an individual resident and The Elite Pianist, LLC.

The person who accepts this agreement on the community’s behalf must be at least 18 years old and authorized to bind the community.

One Membership, One Facility

One membership, one licensed facility

One Elite Pianist Senior Living membership covers one physical facility or community. Additional physical facilities require separate memberships unless The Elite Pianist, LLC expressly agrees otherwise in writing.

An operator that runs several communities does not automatically receive access for every community from a single membership. If you are responsible for more than one location, write to support@elitepianist.com — that is a conversation we are happy to have, and any portfolio arrangement is agreed in writing.

The full terms of what the community is purchasing are also set out in the Institutional Viewing License, which forms part of this agreement.

Membership Price

The current standard price of an Elite Pianist Senior Living membership is $199 per month per licensed physical facility or community, in U.S. dollars.

That is our current standard offer. Where we have expressly agreed different pricing in writing with a particular institutional customer, the agreed pricing controls for that customer.

Applicable taxes may be added where required.

Billing and Payment

An Elite Pianist Senior Living membership is purchased and billed by direct arrangement with The Elite Pianist, LLC rather than through the consumer checkout on our website. The payment method, the invoice or payment process, and any separately agreed billing terms are established directly with the community.

The membership is paid for the period it covers, in accordance with the arrangement established with the community. The community agrees to keep its billing contact and payment details current and to tell us when the responsible contact changes.

Term and Renewal

An Elite Pianist Senior Living membership is a recurring monthly membership. It continues from month to month, on the renewal terms disclosed to the community when the membership is arranged, until it is canceled by the community or ended in accordance with these Terms.

There is no minimum term beyond the period the community has arranged and paid for.

Price Changes

We may change our prices going forward. A price change does not retroactively alter a period the community has already paid for.

Where required or otherwise appropriate, the community will receive advance notice before a changed price applies to a future period, and the community may cancel if it does not wish to continue at the new price.

Cancellation and Ending the Membership

The membership is managed directly with us. To cancel, or for any question about the membership or its billing, the community should write to support@elitepianist.com. Cancellation stops future charges in accordance with the arrangement established with the community.

Unless applicable law requires otherwise, or unless we have expressly stated otherwise, access continues through the end of the period the community has already paid for, and then ends.

When a membership ends or becomes inactive

When an Elite Pianist Senior Living membership ends or becomes inactive:

  • access to protected performance content may end;
  • the community’s institutional account may remain available for account, sign-in and support purposes; and
  • the continued existence of an account does not mean that content access remains active.

The rights described in this agreement and in the Institutional Viewing License apply only while the membership is active.

Refunds

Membership payments are generally non-refundable once they have been charged or invoiced for the period they cover.

We will consider exceptions for:

  • duplicate charges;
  • verified billing errors; and
  • qualifying technical errors attributable to Elite Pianist.

We do not offer refunds for unused membership time or for ordinary dissatisfaction. Nothing in this section limits any refund or cancellation right that applies under applicable law and cannot be waived.

Authorized Viewing at the Licensed Facility

An active membership provides organizational viewing rights for authorized resident and community programming at the licensed facility. Authorized staff may present Elite Pianist programming to residents in appropriate resident-programming spaces at the licensed facility, including:

  • activity rooms;
  • lounges;
  • common areas;
  • theaters; and
  • other appropriate resident-programming spaces.

Residents, appropriate guests and staff may take part in authorized programming at the licensed facility. Group viewing of this kind is exactly what the membership is for, and nothing in these Terms should be read to prohibit it.

The membership does not permit the community to:

  • give its account credentials to residents for unrestricted off-site use;
  • distribute the facility’s sign-in credentials publicly;
  • give another facility access;
  • resell access;
  • redistribute recordings;
  • publicly broadcast the content outside the licensed use; or
  • conduct ticketed public screenings without separate written permission.

Uses outside this agreement and the Institutional Viewing License — for example an event open to the general public, or a program shared across more than one location — require separate written permission from The Elite Pianist, LLC. Write to support@elitepianist.com and we will be glad to discuss it; asking is welcome, and it is usually straightforward to arrange.

The Institutional Account and Its Security

The community is provided with an institutional account for its licensed facility, which authorized facility staff use to reach the Senior Living member experience and to present permitted programming.

The community is responsible for:

  • keeping its institutional account credentials secure;
  • limiting those credentials to the authorized personnel responsible for operating the Service for the licensed facility;
  • how authorized staff and participants use the access provided under the membership; and
  • telling us promptly at support@elitepianist.com if it believes the account has been used without authorization.

The community should also keep its account and contact information accurate, so that we can reach the right person about programming and about the membership.

We may introduce additional or different ways of providing access to a licensed facility in the future, and we will work with the community’s contact if we do. Nothing in these Terms is a promise that any particular additional access method is available today.

Live Programming

Live programming takes place at scheduled times, which are published in the Senior Living member area. Performers, repertoire, schedules, dates, availability and the technical presentation of a performance may change. Except where we have separately and explicitly promised something for a specific event, we do not guarantee a particular number of live performances, particular future dates, or the continued availability of a particular performer or program. A future listing on a calendar is not a guarantee of a particular programme or repertoire.

We may reasonably postpone, reschedule, modify or cancel programming.

How the facility joins a live performance

Live programming is delivered through a third-party live-event platform, such as Zoom or another provider. Each live performance may use its own meeting or streaming link, and there is no permanent link that carries from one performance to the next.

The member area makes the applicable link available at or shortly before the scheduled performance, according to the Service’s current access procedures. We do not promise that a link will be delivered by email, or delivered a particular number of days in advance.

Access links are for the licensed facility’s authorized participants only. The community may not post a live-event link publicly, redistribute it to people outside authorized programming at the licensed facility, use it to provide another institution with access, sell it, or otherwise circumvent membership access requirements.

Because live programming depends on third-party platforms, internet connectivity and compatible devices, availability depends in part on services that are outside our control. See Disclaimers.

Performance Library

An active Elite Pianist Senior Living membership currently includes access to the available institutional performance library for as long as the membership remains active, for authorized programming at the licensed facility.

We may add to, remove from or otherwise change the content in our replay and on-demand library. Membership does not guarantee the permanent availability of any particular recording, and the availability of a particular recording, programme, performer, repertoire item or viewing perspective may change.

Access to a recording through the Service is a license to view it under this agreement. The community does not own the recordings and receives no copy of them.

Camera Perspectives

Some performances are filmed with more than one camera, for example a Main View of the artist and the instrument and an Overhead View of the keyboard.

During a live performance

A live performance may feature multiple camera perspectives, and Elite Pianist selects which perspective is shown during the broadcast. A room watching live may therefore see more than one perspective during the same performance, but does not choose between them.

On supported library performances

On supported library and replay performances, the facility can use Choose Your Perspective to switch between the available camera views itself, while watching.

Whether multiple perspectives are available depends on the particular performance and on technical and production availability. Not every performance is filmed with more than one camera, and no performance is guaranteed to offer multiple perspectives.

Prohibited Uses

Authorized resident and community programming at the licensed facility is permitted, as described under Authorized Viewing at the Licensed Facility. Outside that permitted use, the community agrees not to:

  • copy, download, record, screen-capture or otherwise reproduce the content, except where a feature of the Service is expressly provided for that purpose;
  • redistribute, broadcast, retransmit or upload the content elsewhere;
  • publicly exhibit the content outside authorized programming at the licensed facility, including at events open to the general public or ticketed screenings, without separate written permission;
  • resell, rent, sublicense or otherwise commercialize the access;
  • use the access at any location other than the licensed facility, or to give another facility access;
  • share the institutional credentials outside the authorized personnel described under The Institutional Account and Its Security;
  • circumvent, disable or interfere with access controls or other security or authorization measures; or
  • use the Service unlawfully, or in a way that disrupts it for anyone else.

Intellectual Property

The performances, recordings, commentary, written material, artwork, design, trademarks and other content that make up the Service belong to The Elite Pianist, LLC or to its licensors and contributing artists, and are protected by copyright and other laws.

The membership grants the community a limited, institutional, non-exclusive, non-transferable, revocable right to access and view the content through the Service, for the authorized uses this agreement and the Institutional Viewing License permit, at the licensed facility, and for as long as the membership remains active. No other right is granted, and no ownership transfers to the community.

Nonpayment, Suspension and Termination

If a payment is not made when it is due under the community’s arrangement with us, we may pause content access until payment is made.

We may suspend or terminate access for a material violation of this agreement or of the Institutional Viewing License, including:

  • nonpayment;
  • use at a location other than the licensed facility;
  • unauthorized sharing of institutional credentials;
  • copying, recording or redistribution;
  • public or ticketed exhibition without written permission;
  • resale or sublicensing;
  • attempts to circumvent access controls; or
  • other material violations of these Terms.

Where it is reasonable to do so, we will contact the community first and give it an opportunity to put things right. Nothing in this section waives rights that cannot legally be waived.

Disclaimers

We work hard to make the Service reliable and worth your while, but the Service is provided “as is” and “as available.” We do not warrant that the Service will be uninterrupted, error-free, or free of every defect, and streaming depends on internet connections, devices and third-party platforms that are outside our control.

To the fullest extent permitted by law, we disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, The Elite Pianist, LLC will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue or lost data, arising out of or relating to the Service.

To the fullest extent permitted by law, our total liability arising out of or relating to the Service will not exceed the amount the community paid us for the membership in the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, and nothing here excludes or limits liability that cannot legally be excluded or limited — including, where applicable, liability for fraud, for personal injury caused by negligence, or under consumer protection laws that cannot be waived.

Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules, and subject to any applicable laws and protections that cannot legally be waived.

Talk to us first

Before starting formal legal proceedings, please contact us at support@elitepianist.com and describe the problem. We will make a good-faith effort to resolve it with you informally. Most issues are settled faster and better this way, and we would genuinely rather hear from you.

If we cannot resolve it

If a dispute cannot be resolved informally, it will be brought in the appropriate state or federal courts located in Pennsylvania, to the extent legally permissible, and each party consents to the jurisdiction of those courts. Nothing in these Terms deprives anyone of a right to bring a matter before a small-claims court or a consumer protection authority where that right applies.

Changes to These Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page, and where the change is material we will give notice by reasonable means. Continuing to use the Service after an update means the community accepts the updated Terms.
