Institutional Viewing License

What This License Is

This Institutional Viewing License describes what a senior living community is purchasing when it takes an institutional membership from The Elite Pianist, LLC — Elite Pianist for Senior Living.

It is written to be read before your community agrees to a membership, so that everyone involved — the person signing, the person paying and the person who will actually run the programming — knows exactly what the community is getting.

The Community Is the Customer

With a Senior Living membership, the customer is the community — the licensed facility or organization that arranges the membership — and not any individual resident, family member or staff member.

The community holds the license. Billing is to the community. The rights described here belong to the community and are exercised by the people it authorizes.

This is what makes a Senior Living membership different in kind, and not merely in size, from an individual membership. Individual memberships — Live, Encore and Elite — are for individual use by the named subscriber and carry no organizational or group viewing rights.

One License, One Facility

One Senior Living membership covers one licensed physical facility or community.

Multiple physical facilities require separate memberships, unless The Elite Pianist, LLC expressly agrees otherwise in writing.

An operator with several communities does not automatically receive access for every community from a single membership. If you are responsible for more than one community, write to us — that is a conversation we are happy to have, and any portfolio arrangement is confirmed in writing.

Authorized Organizational Use

The membership provides organizational viewing rights for authorized resident programming and community or group viewing at the licensed facility.

Authorized staff may present Elite Pianist in activity rooms, lounges, common areas, theaters and other appropriate resident-programming spaces. Residents, appropriate guests and staff may take part in authorized programming at the licensed facility. Group viewing of this kind is exactly what the membership is for, and nothing in this license should be read to prohibit it.

Customized Onboarding

Onboarding is part of the membership, not an administrative hurdle attached to it.

Communities are not alike. A community whose residents are largely independent has different needs from one whose programming is entirely staff-led, and a community with a dedicated theater has different needs from one where the experience will live in a single activity room. Rather than pushing every community through the same setup, we work out the right configuration with you.

During onboarding we determine, with you, how the programming will run inside your facility, who will hold and use the community’s access, and what practical setup makes sense for your program, your staff and your residents.

Your Designated Coordinator

Each community identifies an appropriate representative for us to work with. That might be a:

• life enrichment or activity director;
• program coordinator;
• facilitator;
• administrator;
• programming or resident-services staff member; or
• other appropriate organizational representative.

That person is our primary contact for the community. They are the person we plan with during onboarding, the person we reach out to about programming, and the person responsible for how the community’s access is used. Please let us know when the appropriate contact changes, so that nothing falls between two desks.

How the License Is Delivered

Access is provided to the community through the community’s own account with us, and the practical setup is agreed with you during onboarding.

Facilitated programming

Authorized staff present Elite Pianist to a group in an appropriate space at the licensed facility — an activity room, lounge, theater or common area. Live performances are joined at their scheduled times; performances in the available library are watched whenever suits the community’s program.

What the community’s access includes

While the membership is active, the community’s access covers the upcoming live performances included in the Senior Living program, the performances available in the Senior Living library, and the viewing perspectives supported on a given performance. On supported library performances, the person running the programming can switch between the available camera perspectives using Choose Your Perspective. During a live performance, The Elite Pianist selects which perspective is broadcast.

We may introduce additional or different ways of providing access in future, and we will work with your coordinator when we do. Nothing in this license is a promise that any particular additional access method is available today.

Who May Take Part

The community’s access is tied to the licensed facility, and is for authorized programming at that facility.

• the access is associated with the licensed facility;
• residents, appropriate guests and staff may take part in authorized programming there;
• it may not be transferred or sold;
• it may not be used to provide another facility with access;
• it may not be shared outside the licensed facility, including with residents’ friends or family for use elsewhere; and
• the rights described here end when the community’s membership ends or is no longer active.

The community is responsible for keeping its account details secure, for limiting them to the staff it authorizes, and for use of the account by anyone it gives access to. We may introduce and change the practical means by which access is established and periodically reconfirmed, and we will work with your coordinator when we do.

What This License Does Not Cover

The membership does not by itself authorize:

• public ticketed screenings;
• commercial public exhibitions;
• events open to the general public;
• use at any location other than the licensed facility;
• copying;
• recording;
• redistribution;
• uploading performances anywhere else;
• sublicensing;
• resale; or
• commercial distribution.

Access provided under the membership may not be transferred outside the licensed facility, and may not be used to give another facility access.

Requesting Written Permission

Uses outside this license require separate written permission from The Elite Pianist, LLC. If your community would like to do something this license does not cover — an event open to the public, a ticketed benefit, a program shared across more than one facility — write to support@elitepianist.com. Asking is welcome, and it is usually straightforward to arrange.

Term, Renewal and Ending the License

A Senior Living membership is a recurring monthly membership. It continues until it is canceled, on the terms arranged directly with the community, and the community may cancel by writing to us.

Unless applicable law requires otherwise, or unless we have expressly stated otherwise, access continues through the end of the period the community has already paid for. The rights described in this license apply only while the membership is active, and the access provided under it ends with it.

Relationship to the Senior Living Terms

This Institutional Viewing License forms part of the community’s agreement with The Elite Pianist, LLC, together with the Senior Living Terms of Service and the Privacy Policy.

The Senior Living Terms govern the wider relationship — price, billing, renewal, cancellation, refunds, intellectual property, content availability, suspension and termination, disclaimers, limitation of liability, governing law and the dispute process. Where this license addresses organizational use specifically, it is read together with those Terms.
